Elizabeth Day vs. Thomas Day - Bill of Divorce

This case came on to be heard in the probate court for said county, at the September term of the said probate, eighteen-hundred and sixty nine to wit of the thirtieth day of November of said year, upon the petition of the said Elizabeth Day, and upon the investigation thereof, it was made to appear that the said parties could not live together in peace and union and that their welfare and especially that of the said Elizabeth, agreed that they should be separated and after hearing the evidence and other arguments of the parties and being further advised in the premises it is ordered adudicated and by ___ by the court that the bonds of matrimony heretofor existing between the said Elizabeth Day and Thomas Day be and the same one home be forever dissolved and declared to be null and void and of no effect.
It is further ordered and adjudicated that this said Elizabeth shall have and retain the custody and control of her minor children during their minority and that she pay costs of said taseld of $.
